1. Agreement to Terms

By downloading, accessing, or using the FerryShare mobile application and related services (collectively, the "Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Platform.

These Terms constitute a legally binding agreement between you and FerryShare Technology Inc. ("FerryShare," "we," "our," or "us"), a company incorporated in British Columbia, Canada.

2. Nature of the Platform

Non-Commercial Cost-Sharing — Important

FerryShare is a non-commercial cost-sharing platform. It is not a transportation network service, ride-hailing service, or taxi service. FerryShare is not a Transportation Network Company (TNC) as defined under the Passenger Transportation Act (British Columbia), and it does not operate, license, or dispatch transportation for hire.

Drivers on FerryShare are private individuals who are already travelling on BC Ferries routes for their own purposes. They are not providing a transportation service — they are sharing the actual costs of a trip they were already making. No driver on FerryShare is permitted to profit from offering rides. Any commercial use of this platform is strictly prohibited and will result in immediate account suspension.

FerryShare is a digital platform for non-commercial cost-sharing trips. FerryShare connects private individuals who wish to share actual travel costs, particularly for BC ferry routes and regional travel in British Columbia.

By using FerryShare, you acknowledge and agree that you understand this distinction.

3. Eligibility

To use FerryShare, you must:

Vehicle Eligibility: FerryShare is currently available for private passenger vehicles only. Commercial vehicles, work trucks, vans, or any vehicle primarily used for business or commercial purposes are not permitted on FerryShare at this time. Offering rides in a commercial vehicle is a violation of these Terms and will result in immediate account suspension.

5. Driver Responsibilities

If you offer rides as a driver on FerryShare, you represent and warrant that:

Insurance Notice: Standard personal auto insurance policies in BC may not cover passengers paying a fare. Drivers are responsible for ensuring their insurance coverage is appropriate for cost-sharing trips. FerryShare recommends consulting your insurer before offering rides.

BC Carpooling Compliance: To comply with BC's Passenger Transportation Regulation carpool exemption, drivers should use their actual starting point as the pickup location and their actual destination as the dropoff location. All passengers in a FerryShare ride share the same pickup and dropoff points as posted by the driver.

One Ride Per Day: Drivers may not post more than one ride per calendar day in the same direction to comply with BC's Passenger Transportation Regulation carpool exemption. FerryShare enforces this limit automatically.

BC Ferries Reservations: If you have a BC Ferries vehicle reservation, note that your reservation specifies the number of passengers. If you check in at the terminal with more passengers than originally booked, the ticket agent will charge the additional passenger fares at the booth. BC Ferries supports this process at all terminal ticket booths.

7.1 Ride Pricing

Ride prices on FerryShare are based on a cost-sharing formula that estimates the driver's actual travel costs divided among passengers. Pricing is calculated based on:

7.2 Booking Fee

FerryShare charges a platform booking fee of 18% of the ride cost, capped at $9.00 CAD per passenger. This fee covers platform operation, payment processing, customer support, and identity verification infrastructure.

The booking fee is charged through Stripe at the time of booking. The driver receives nothing through the app. Passengers pay drivers directly at pickup.

7.3 Payments

All booking fee payments are processed through Stripe. By making a payment, you agree to Stripe's Terms of Service. FerryShare does not store your payment card information.

8. Cancellations and Refunds

8.3 Driver Strike System

FerryShare records a strike on a driver's account for each post-chat cancellation or confirmed no-show. Accumulating 3 or more strikes results in automatic account suspension. Suspended accounts may not offer rides and will be reviewed by FerryShare.

8.4 No-Show Disputes

The "I'm at the pickup point" check-in feature records GPS coordinates and server timestamps for both drivers and passengers. This data may be used to resolve no-show disputes. FerryShare's decision on dispute outcomes is final.

If you believe a refund was incorrectly processed, contact support@ferryshare.com within 7 days of the ride date with your booking ID.

8.5 Driver Direct Payment

Because drivers are paid directly by passengers outside the app, FerryShare is not responsible for recovering driver payments. Refunds and credits described in this section apply exclusively to the FerryShare booking fee charged through Stripe.

9. Identity Verification

FerryShare offers optional identity verification through Stripe Identity. Verification costs $2.99 CAD, which covers the cost of the verification service. FerryShare does not profit from identity verification fees.

Verified users receive a verification badge on their profile. Verification does not constitute an endorsement by FerryShare of any user.

After 30 days of account age, unverified users may be required to complete identity verification before booking or offering rides.

10. Platform Credits

FerryShare Platform Credits ("Credits") are issued in lieu of cash refunds in certain cancellation scenarios (see Section 8).

To protect drivers from no-shows and ensure a reliable experience for all users, FerryShare operates two mandatory pre-ride systems.

12. Platform Integrity

FerryShare is funded entirely by platform booking fees. Bypassing these fees undermines our ability to maintain the service.

12.1 Off-Platform Arrangements

Sharing contact information after a booking is confirmed is permitted and expected (so passengers and drivers can coordinate pickup details). However:

Drivers are held to a high standard of reliability. Cancelling after chat has opened (within 24 hours of departure) or failing to appear at pickup counts as a strike. Accumulating 3 or more strikes results in automatic account suspension.

13. Ratings and Reviews

After each completed ride, drivers and passengers may rate each other. Ratings must be honest and based on your actual experience. False, defamatory, or retaliatory ratings may result in account suspension.

FerryShare is a technology platform that facilitates connections between private individuals. FerryShare is not a party to any cost-sharing arrangement between drivers and passengers.

FerryShare is not responsible for:

FerryShare's total liability to you for any claim arising from use of the Platform shall not exceed the amount of booking fees paid by you in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless FerryShare Technology Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

17. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of British Columbia.

18. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the app at least 14 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

19. Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or conduct that harms other users or FerryShare. You may delete your account at any time through the app settings.

Platform Credits are forfeited upon account termination for cause.
